PDF Text Edit-Kun Terms of Use (End User License Agreement / EULA)

This English text is a translation of the Japanese Terms of Use above, and both form one agreement. If there is any difference between them, the Japanese text prevails.

These Terms of Use (these "Terms") are a license agreement between the user of "PDF Text Edit-Kun" (known in Japan as "PDF編集くん"; the "App") and the developer of the App (the "Developer"). By downloading, installing, or using the App, you are deemed to have agreed to these Terms. If you do not agree, please do not use the App.

Article 1 (Parties to these Terms)

These Terms are concluded between you and the Developer, not between you and Apple Inc. ("Apple"). The Developer, not Apple, is responsible for the App and its content.

Article 2 (License)

The Developer grants you a non-transferable, non-sublicensable, non-exclusive right to use the App on Apple devices that you own or control, to the extent permitted by the Apple Media Services Terms and Conditions (the "Usage Rules"). You may not use the App beyond what the Usage Rules permit.

Article 3 (Prohibited acts)

When using the App, you must not do any of the following.

If you violate Article 3, you are fully responsible for any liability arising from that act.

Article 4 (User responsibilities)

  3. You can manage or cancel your subscription at any time in Settings > Apple Account > Subscriptions on your device. If you cancel, you can keep using Pro until the end of the period you have already paid for.
  4. "Lifetime" is the right to use the App's Pro features with no additional charge for as long as the App is offered. It does not guarantee that the App will work on future operating systems or devices, and the Developer may discontinue the App. Features may be added, changed, or removed.
  5. Refunds and cancellations of purchases are subject to Apple's policies. The Developer cannot decide whether a refund is granted.
  6. A one-time purchase can be restored on another device signed in to the same Apple Account with "Restore Purchases."

Article 6 (Advertising)

In Lite (free), ads from Google AdMob are shown. Advertisers are responsible for the content of ads and for the advertisers' services. For how information is handled, please see the Privacy Policy.

Article 7 (Intellectual property and third-party software)

Copyright and other intellectual property rights in the App belong to the Developer or the rightful owners. These Terms do not transfer any of those rights to you. Rights in the PDFs you edit belong to their rightful owners.

The App uses the following third-party software.

Article 8 (Disclaimer of warranties and limitation of liability)

  1. The App is provided "as is." The Developer does not warrant that the App can edit every PDF as expected, that it is free of errors or interruptions, or that it is fit for any particular purpose (except where applicable law does not allow warranties to be excluded).
  2. The Developer is not liable for damages arising from the use of, or inability to use, the App (including changes to, corruption of, or loss of the contents of a PDF, and the results of decisions or transactions made on the basis of the edited result), except where the Developer acted intentionally or with gross negligence.
  3. Where the Developer is negligent (other than grossly negligent), the Developer's liability is limited, to the extent not contrary to law, to the amount you paid for the App up to the time the damage occurred. However, this limitation does not apply where it is not permitted by the Consumer Contract Act or other laws.

Article 9 (Terms regarding Apple)

You and the Developer acknowledge the following.

  1. Parties to these Terms: These Terms are concluded only between you and the Developer. Apple is not a party.
  2. Maintenance and support: Apple has no obligation to provide maintenance or support for the App.
  3. Warranty: If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if it was paid). To the maximum extent permitted by applicable law, Apple has no other warranty obligation regarding the App. Any other claims, losses, liabilities, damages, and costs relating to a warranty are the Developer's responsibility.
  4. Product claims: The Developer, not Apple, is responsible for claims by you or a third party relating to the App or your use of it (including product liability claims, claims that the App fails to conform to laws or regulations, and claims under consumer protection laws).
  5. Intellectual property rights: If a third party claims that the App or your use of it infringes its intellectual property rights, the Developer, not Apple, is responsible for investigating, defending, settling, and discharging the claim.
  6. Legal compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
  7. Developer contact: For questions, complaints, or claims regarding the App, please contact us through an Issue on our GitHub repository (https://github.com/seishimurakami/DONUT-DROP/issues).
  8. Third-party terms: When using the App, you must comply with applicable third-party terms (such as your telecommunications service agreement).
  9. Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple is deemed to have the right, as a third-party beneficiary, to enforce these Terms against you.

Article 10 (Changes to these Terms and suspension of use)

  1. The Developer may change these Terms when necessary. The revised Terms take effect when they are posted on this page.
  2. If you violate these Terms, the Developer may terminate your license to use the App without notice.

Article 11 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. If a dispute arises regarding the App, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance by agreement. This does not affect any rights granted to you by law.
